Mike Anderson’s New Law Blog

Mike Anderson, a soon-to-be graduate of Boalt Hall, has started his new blog, Mere Dicta, with a bang. He discusses the Supreme Court’s review of the Hamdi and Padilla “enemy combatant” cases and makes the argument that, at least for Padilla, his perpetual detention without charges flies in the face of the Constitution’s treason clause. The main idea is that the treason clause is rendered meaningless if it isn’t applied in an allegedly clear case of treason like Padilla’s.
