I believe a more nuanced regulation is advisable and that the current regulation may well be contrary to the law. The latter point may have to be decided by a court, but if Fish and Wildlife was as surprised by this as the most recent New York Times article suggests, they should seriously consider revising their regulations without being forced to do so by a court.
